Florida Vape Ban

The Florida Vape Registry has taken effect. Unlike other state registry lists, Florida is the first state in the nation to include a carve-out for refillable pod systems, bottled e-liquids, open-system vaping products, and other nicotine dispensing devices that are not prefilled.

The legislation seeks to fix flaws in the FDA's PMTA process, which has approved only a few outdated, costly tobacco products, while maintaining state level oversight of naming, packaging, and appearance of vaping products.

Rather than the typical registry, which provides a small list of smattering of approved products, the Attorney General operates a website which lists barred products.

Nicotine Dispensing Device Directory

The Directory of Nicotine Dispensing Devices (NDD Directory) is the list of barred products and can be found on the Office of the Attorney General State of Florida website.

How Products End Up On the Florida Vape Ban List

The Florida Attorney General’s Office relied on several sources to create the Florida Vape Ban List. These included harm reports, complaints, surveys and other data sources indicating underage abuse to determine if a device should be listed on the nicotine dispensing device directory. The law focuses primarily on underage use.

• Is designed to be attractive to minors, such as through the use of bright colors or cartoon characters.
• Is designed so that it is easy for minors to use and to conceal.
• Uses or resembles the trade dress of a branded food product, consumer food product, or logo of a food product.
• Is marketed in a manner that uniquely appeals to minors; or
• Uses actual copyrights, service marks, or trademarks or fake copyrights, service marks, or trademarks that resemble consumer or food products popular with minors, including the names of candy or cereal products.

Hefty Fines

• Beginning March 1, 2025, manufacturers that sell prohibited products in the state will face a $1,000 daily fine for each such product until it’s removed from the market. This stricture will also apply to retailers, wholesalers and distributors that ship products into the state.
  
• A person who knowingly sells, ships, or receives for retail sale a prohibited device commits a first-degree misdemeanor. Other violations are enforced by the Attorney General as a deceptive trade practice and are also subject to a civil penalty of $1,000 per prohibited device sold.
  
• Any person who sells a nicotine product, including vapes, to someone under 21 for a third or subsequent time will face a third-degree felony charge, punishable by up to $5,000 in fines and five years in prison.

Disposable Vape Products on the NDD Directory

The following disposable vapes carried on are not permitted for sale in Florida because they are listed on the NDD Directory. This is not to be considered legal advice, and the list is subject to updates. We recommend registering to receive updates from the Attorney General, with the link provided above. 

Notes on NDD Directory Listing

The source of this first NDD Directory is worth examining and we did edit the results for clarity. It is clear that these product names were lifted directly from the websites of distributors. And not all of these distributors are even doing business in Florida.

If you download their Excel file, column C contains many internal tracking numbers from Mi-Pod, specifically any SKU that starts with a 5. There are a hodge podge of other SKUs. These products were banned without very much forethought or research. 

But the real question is why is the Florida Attorney General looking to protect Floridians by lifting products from an Arizona business website that is 100% compliant with their laws?

There are also an inordinate number of vapes that really are not on the market any more but were popular some years ago. Good luck finding a Hyde 3000.

Keywords like cake and dragon were applied, even if cake and dragon fruit are not particularly kid appealing. They also mixed in product lines with no flavors lifted and several Mr. Fog case quantity products.  

It is great that Florida is attempting to handle this case by case. But it is not much of a solution if they lift all the SKUs from a major distributor for May and ban every current product. It is important that residents audit this and demand transparency. It is consumer freedom and adult access at stake.

Public Health and Banning Nicotine Dispensing Devices

General public health is not aided by restricting adult access, as vape flavor bans have been shown in myriad studies increase the sale of combustible tobacco products.

Attacks on flavored vapes have been a constant for the US vaping industry, as the vast majority of adult vapor consumers prefer fruit, beverage and dessert flavored vaping products to the fake tobacco flavored e-liquid pods that the FDA has determined were socially acceptable. 

That the Florida legislature has attempted to police what businesses can sell without tossing every popular product off the market with their new law is a step in the right direction.

Origin of the Florida Vape Ban List

In an ideal world, the fact underage vaping has hit a ten-year low thanks to Tobacco-21 would be sufficient to quell the demand for restrictions on electronic nicotine dispensing devices. CDC data had always shown that it was older peers and family members under 21 that provided youth access to nicotine products.

Accepting this reality is not easy if you receive money from the tobacco industry or from the constellation of nicotine prohibitionist groups funded by Michael Bloomberg. The Florida Retail Federation, with many of its largest members dependent on the sale of tobacco products and the Big Tobacco distribution model, has been one of the most vocal proponents of a de facto vape ban in the form of PMTA Registry bill.

Politicians in face similar pressures in all fifty states thanks to a full court press by the tobacco industry to pass PMTA Registry Laws that ban all but the six overpriced pod kits that they happen to manufacture. In its original form, the Florida Vape Ban would have been a real vape ban that would have prohibited sales of any vape products that had not yet received FDA approval.

Refillable Vapes Receive a Reprieve

Florida Smoke Free Association president and vape shop owner Nick Orlando was the driving force behind getting the state to adopt rules that that provide an exemption for refillable vape devices and to reject a blanket ban on the disposable vapes that a vast majority of adult nicotine users use. The very disposable vapes that are cutting so deeply into Altria's bottom line that they are mentioned in detail during every quarterly earnings call.

The law now directs the state’s Department of Legal Affairs to develop and maintain a directory listing all single-use nicotine vapes it deems attractive to minors. The Attorney General's Office must make the list publicly available on Jan. 1, 2025, and regularly update it.

Vaping Treated the Same as Tobacco Products

We have come a long way from the earliest days of vaping. It was once like the wild west with vaping in enclosed indoor workplaces abused and fly by night businesses featuring stolen IP or relying on garish cartoons. But the pendulum has swung too far and is approaching total prohibition in some areas.

Vaping should not be limited to tobacco flavored gas station pod vapes furtively puffed with the curtains drawn in shame within a private residence. 

Without de facto bans on all but tobacco industry cigalike pod products, vaping can thrive as an adult alternative product and remain available in the varieties of flavors and options necessary to sustain both independent businesses and their myriad customers who would otherwise be funneled back onto combustible cigarettes.
