West Virginia is tightening regulations on e-cigarettes with the introduction of Senate Bill 93 (S.B. 93)—a law that establishes a state directory for e-cigarette products. What Does S.B. 93 Require? 

 

Under S.B. 93, West Virginia will create and maintain a directory of approved e-cigarette products. To be listed in this directory, products must meet the following requirements: 

 

  • FDA Authorization: Only products that have received Premarket Tobacco Product Application (PMTA) approval or other FDA authorization will be allowed. 

  • Annual Certification: Manufacturers must certify their products each year to remain in compliance. 

  • Enforcement Measures: Retailers and distributors will be prohibited from selling e-cigarettes that are not listed in the state directory. 

  • Penalties for Non-Compliance: Businesses that violate these regulations could face fines, legal action, or other penalties.
