
North Dakota’s HB 1003: A Dangerous Step Toward Vape Bans
North Dakota vapers, business owners, and consumer freedom advocates—there’s a new threat to your rights. Last week, the North Dakota House passed an amendment to HB 1003, introducing a PMTA (Premarket Tobacco Product Application) registry and allocating funding to enforce it. Now, the bill has moved to the Senate, and it’s critical that we take action to stop it.
What is HB 1003 and Why Does It Matter?
HB 1003 is an appropriations bill, but it now contains language that could severely impact vape businesses and consumers in North Dakota. The PMTA registry would require retailers and distributors to only sell vaping products that have completed the lengthy and expensive FDA PMTA process—a process that has been criticized for favoring big tobacco companies while pushing small businesses out of the market.
The reality is that very few vaping products have received FDA approval, meaning this bill could effectively ban the majority of vaping products in North Dakota, cutting off adult consumers from the alternatives to conventional cigarettes.

After passing the House, HB 1003 is now in the Senate. This means there’s still a chance to fight back before it becomes law. Vapers, businesses, and advocates must take action now to protect consumer choice and small businesses in the state.
