Indiana Vape Bans & Overregulation: What You Need to Know

Indiana lawmakers are considering two bills that could severely impact the availability of vapor products in the state. H.B. 1218 seeks to ban the sale and distribution of all e-liquids and vapor products starting July 1, 2025, while H.B. 1650 would establish a burdensome regulatory framework, including a PMTA registry. 

 

These bills threaten consumer choice, small businesses, and smoke-free nicotine alternative efforts. If passed, Indiana would eliminate access to superior alternatives to smoking and create an enforcement nightmare for retailers.

🚫 H.B. 1218 – A Full Ban on Vapor Products 

 

A De Facto Prohibition – This bill completely bans e-liquids and vapor products in Indiana starting July 1, 2025, regardless of their compliance with federal regulations. 


Harms Alternative Nicotine Products – Eliminating legal vapor products forces consumers back to combustible cigarettes or unregulated markets.

Creates a Burdensome PMTA Registry – The bill establishes a state-run registry for products with a pending or approved PMTA (Premarket Tobacco Product Application). 


Favors Big Tobacco – The FDA’s PMTA process has unfairly restricted independent brands while allowing Big Tobacco-backed products to dominate the market.
