FDA Warns Firms Illegally Selling E-Cigarettes Resembling Smart Technology Devices

On October 30, 2024, the FDA made a bold move by issuing warning letters to nine online retailers and one manufacturer for selling disposable e-cigarettes disguised as smart devices. These unauthorized e-cigarettes resemble phones, gaming devices, and other tech gadgets—complete with features that may appeal to youth, like games, smartphone connectivity, text or call notifications, music capabilities, and even customizable wallpapers. According to the FDA, these designs not only mimic popular tech but could also make it easier for kids to hide them from parents and teachers. 

Brian King, Ph.D., M.P.H., director of FDA’s Center for Tobacco Products, didn't mince words: “These products may resemble smart devices, but there’s nothing smart about them. They’re illegal to sell and a flagrant attempt to target kids.”

 

Why This Move Is a Step Forward for Responsible Vaping 

Mi-Pod made a deliberate choice not to invest in these gimmicky “smart” vape devices with Bluetooth tech and games. Adding games and smartphone connectivity to e-cigarettes blurred the lines and seemed like a risky choice that could easily draw negative attention. This kind of product appeals to young people for all the wrong reasons, and that’s not something Mi-Pod ever wanted to be associated with. 

Youth Appeal: The FDA’s Core Concern 

The FDA’s primary concern with these tech-inspired e-cigarettes is their potential appeal to underage users. When e-cigarettes look like smartphones or gaming consoles, it becomes easier for young users to hide them in plain sight. The agency argues that these tech-style designs are deceptive by nature, aiming to normalize e-cigarette use among youth and make it harder for parents, teachers, and other adults to spot. This aspect is particularly problematic in schools and at home, where adult supervision is meant to deter underage vaping. 

The Importance of a Responsible Approach 

Our stance has always been clear: e-cigarettes should be straightforward nicotine delivery systems optimized for adult smokers who want an alternative to traditional cigarettes. We believe in transparency and a responsible approach to vaping products, which is why we never ventured into “smart” vape territory. We don’t believe that features like games or Bluetooth connectivity align with the primary purpose of vaping products, which is to provide adult vapor consumers with affordable and efficient products. 

FDA Enforcement and the Future of Vaping Products 

The FDA’s recent actions highlight a clear shift towards enforcing stricter regulations against vape products that blur the lines between nicotine delivery systems and smart technology. Moving forward, it’s likely that the FDA will keep a close eye on e-cigarette designs and marketing strategies to ensure they aren’t targeted toward youth. This might mean even more regulations are coming, but for us, this is a change we welcome. 

As an industry, we need to focus on delivering high-quality, straightforward vaping products that appeal to adult using combustible tobacco products and adult nicotine vapor consumers. Unnecessary bells and whistles don’t contribute to that goal, and in fact, they detract from the industry's credibility and long-term viability.

In a rapidly changing regulatory environment, companies that have taken a straightforward, responsible approach to vaping products are likely to benefit. We intentionally have avoided selling products with unnecessary gimmicks and are laser focused on our mission of providing adult consumers with reliable, high-quality vaping options. The FDA’s latest crackdown serves as a reminder of the importance of this approach and reinforces our commitment to being a responsible player in the industry.
