Then, on January 3, 2023, a federal appeals court delivered the long-awaited decision: the marketing denial orders issued to Triton Distribution were reversed, and the FDA was ordered to conduct new reviews of the company's marketing applications.

In a comprehensive 52-page decision, the en banc panel of judges voted 10-6 in favor of granting Triton's petitions for review. The court determined that the FDA had acted "arbitrarily and capriciously" in rejecting Triton's premarket tobacco product applications (PMTAs), signaling a victory not only for Triton but for the entire vaping industry.
