Victory for Vapers: The Return of Suicide Bunny E-Liquids and the Fight Against FDA Regulations
The return of Suicide Bunny e-liquids to the market in traditional nicotine forms marks a significant victory for both vapers and the vaping industry as a whole. Created by Pip Gresham as a means for her and her husband to quit smoking, Suicide Bunny e-liquids quickly became renowned for their delicious flavors and edgy artwork, captivating vapers worldwide. In July of 2015 Pip was asked by Vape Magazine how her mission evolved and her goals for the future. Her powerful response still resonates with the vaping community to this day.
“I started to get one person to stop smoking, and my goal has changed to a multitude of people. I won’t stop until I get the whole world off cigarettes.”
However, the journey hasn't been without its challenges. Like many other vaping products, Suicide Bunny faced obstacles due to stringent FDA regulations. Following a Marketing Denial Order (MDO) from the FDA, Suicide Bunny, now produced by Triton, embarked on a legal battle to challenge the decision. Initially denied by a three-judge panel, Triton persisted, eventually earning a rehearing of the appeal.
The turning point came in mid-October 2021 when the Fifth Circuit Court of Appeals granted Triton a full judicial stay, allowing the company to continue selling its products while the lawsuit remained active. Then, on January 3, 2023, a federal appeals court delivered the long-awaited decision: the marketing denial orders issued to Triton Distribution were reversed, and the FDA was ordered to conduct new reviews of the company's marketing applications.
In a comprehensive 52-page decision, the en banc panel of judges voted 10-6 in favor of granting Triton's petitions for review. The court determined that the FDA had acted "arbitrarily and capriciously" in rejecting Triton's premarket tobacco product applications (PMTAs), signaling a victory not only for Triton but for the entire vaping industry.
The reinstatement of Suicide Bunny e-liquids in traditional nicotine forms not only celebrates consumer choice and access to innovative harm reduction products but also serves as a beacon of hope for other manufacturers facing similar regulatory challenges. It underscores the importance of perseverance, advocacy, and legal action in defending vaping rights and challenging regulatory overreach.
Furthermore, supporting Suicide Bunny and other vaping brands that have fought tirelessly against FDA regulations is crucial for the ongoing battle against excessive government interference. By choosing these products, consumers send a clear message that they refuse to be silenced or restricted in their choices for safer alternatives to smoking.
The triumphant return of Suicide Bunny e-liquids to the market exemplifies the resilience of the vaping community and its commitment to defending freedom of choice. As we celebrate this victory, let us continue to stand together, advocate for sensible regulations, and support businesses that champion vaping rights.
